Desktop Font License

This license agreement for YouWorkForThem Font Software becomes a legally binding contract between the licensee and YouWorkForThem when the licensee agrees to the Terms of Condition in an electronic delivery method or purchases the YouWorkForThem Font Software on a storage medium and opens the packaging containing the fonts.

If the licensee refuses to accept a contractual obligation through this license agreement, he is not permitted to access, use or download the YouWorkForThem Font Software. The licensee should thoroughly and carefully read through the complete license agreement before agreeing to the conditions specified here.

The YouWorkForThem Font Software underlying this agreement is the intellectual property of the YouWorkForThem and/or its licensors. It contains YouWorkForThem Font Software with digital, machine-readable, scalable font software data, and is supplied to you by YouWorkForThem for usage only, however not sold. Usage of the YouWorkForThem Font Software is ruled by this license agreement.

Multi-User Pricing Structure
We offer an easy and cost-effective way to purchase multi-user licenses for YouWorkForThem Fonts. Our pricing plan is quite simple: all YouWorkForThem Fonts are covered for two users/computers. Every additional user/computer beyond the first two is charged an additional 20% of the YouWorkForThem Font price. For example, a $20 YouWorkForThem Font with a three-user license would cost a total of $24. You can calculate this price anytime via the shopping cart page. While not common, if the original font designer has opted out of the multi-user discount program on our website, the addition of users will be at the full price of the font.

Upon full payment of the agreed-upon license fee, you are granted:
1.1 A non-exclusive, single user right to use the YouWorkForThem Font Software on up to two computers at one single geographical location stipulated by the licensee. If the YouWorkForThem Font Software will be installed on more than two hard disks and will be used by several systems, an additional license must be acquired for each additional system from YouWorkForThem. YouWorkForThem does not guarantee that the YouWorkForThem Font Software will work adequately in an environment with many systems. YouWorkForThem reserves all rights not expressly granted to you under this license Agreement. The YouWorkForThem Font Software is solely for use in your own business or for your own personal use, and it remains YouWorkForThem's ownership at all times.

1.2 The right to make additional backup copies of the YouWorkForThem Font Software for the exclusive purpose of data backup. You can keep backups of the YouWorkForThem font(s) in the cloud, locally on a desktop, laptop or mobile device, or on a studio server, ONLY IF you, as the single licensee of the YouWorkForThem font(s) is the only person who maintains the backup. It cannot be managed by numerous users. You cannot make any YouWorkForThem fonts available for download on the internet, email them to friends, or trade them on file sharing networks.

1.3 One additional usage (installation) on a personal home or portable computer if the YouWorkForThem Font Software is intended to be used for commercial purposes.

1.4 For the exclusive purpose of outputting certain files, the licensee is permitted to transfer a copy of the YouWorkForThem Font Software which is used for creating the pertinent file to a commercial printer or another service company. In the event of any text modification, the service company is required to possess its own license. The licensee has to inform the commercial printer/service company about the content of this license agreement. This license does NOT cover embedding for WebFonts, Computer Software, eBooks, Mobile Applications, Video Games or other similar commercial products. You need to purchase an Extended Font License from us for this type of scenario.

1.5 You can use YouWorkForThem Font Software to print as many copies of anything as you like, with no limits on number of impressions or print size. You can use YouWorkForThem Font Software in television campaigns with no extra license needed. You can use YouWorkForThem Font Software for anything web-related via flattened image formats (jpeg, png, Flash, Quicktime, etc), except making them available to others for download, or making them available for others to use as part of an interface for a web server-based program. You can use YouWorkForThem Font Software to create artwork for clothes, packaging, posters, coffee mugs or similar commercial products that you, your company, or your clients are selling. This license does NOT license the YouWorkForThem Font Software for WebFont use.

2. Proprietary Rights and Obligations
The YouWorkForThem Font Software is the valuable property of YouWorkForThem. You will not make or have made, or permit to be made, any copies of the YouWorkForThem Font Software, documentation, or any portions thereof, except such copies as are necessary for the installation of the YouWorkForThem Font Software in accordance with the terms of this Agreement. Any such copies of the YouWorkForThem Font Software shall contain the same propriety notice which appears on or in the YouWorkForThem Font Software.

3. Assignment
Assigning the license to a third party is essentially not permitted. By way of exception, the licensee is authorized to transfer the usage rights and license to a third party only upon compliance with all of the following conditions: The third party has expressly declared to the licensee to strictly and unrestrictedly submit and adhere to the conditions of this license agreement for YouWorkForThem Font Software (see exhibited 2). In the event of transfer of the license to a third party, the licensee agrees and is obligated to refrain from further usage of the YouWorkForThem Font Software, and, regardless of where it is located, agrees and is obligated to delete said software and is not permitted to retain any copies, in whole or in part, of such.

4. Font Embedding
Embedding of the YouWorkForThem Font Software into electronic documents (PDFS, Word, etc) of Internet pages is only permitted under the absolute assurance that the recipient cannot use the YouWorkForThem Font Software to edit or create a new document (read-only). It must be ensured that the Font Software cannot be fully or partially extracted from said documents. This license does NOT license the YouWorkForThem Font Software for WebFont use.

The licensee may electronically distribute YouWorkForThem Font Software embedded in a “Personal or Business Use' document only when the YouWorkForThem Font Software embedded in such document is in a static graphic image (for example a GIF or JPEG) or an embedded electronic document, and is distributed in a secure format that permits only the viewing and printing (and not the editing, altering, enhancing, or modifying) of such static graphic image or embedded document. The licensee may not embed YouWorkForThem Font Software in a Commercial Product without a separate written license from YouWorkForThem, and the licensee may not embed YouWorkForThem Font Software in an electronic document or data file for any reason other than his own Personal or Internal Business Use.

If the licensee intends to edit or modify a document containing the embedded YouWorkForThem Font Software, a request must be made to YouWorkForThem. YouWorkForThem will then conclude an expansion/embedding license agreement for said purpose. This expansion/embedding license agreement is subject to an additional fee (see exhibit 3). This license does NOT cover use or embedding for WebFonts, Computer Software, eBooks, Mobile Applications, Video Games or other similar commercial products. You need to purchase an Extended Font License from us for this type of scenario.

5. Exclusion of Other Usage
Subject to the provisions 1.4 and 3 of this agreement, selling, lending or otherwise transferring the YouWorkForThem Font Software to a third party or parties is strictly prohibited. In addition, transferring the YouWorkForThem Font Software as a component or sub-component of other products, e.g. electronic documents or sub-licenses, to a third party or parties is also strictly prohibited.

Furthermore, licensee agrees not to modify, adapt, translate, rent, lease, resell, distribute, produce, reverse engineer, decompile, disassemble, re-digitize or create derivative works or typefaces based on the YouWorkForThem Font Software or the typefaces created electronically or in hard copy form as a result of the use of the YouWorkForThem Font Software.

Specifically, it is prohibited to change or modify the Font/Trademark names used as identifying tags in the YouWorkForThem Font Software in any form or manner. If such changes or modifications become necessary, prior written consent has to be obtained from YouWorkForThem.

6. Exclusivity
YouWorkForThem retains title and ownership of the YouWorkForThem Font Software and all subsequent copies of the YouWorkForThem Font Software, regardless of the form or media in or on which the original and other copies may exist. Except as stated above, this Agreement does not grant you any rights to trademark or any other intellectual property rights in the YouWorkForThem Font Software or in any typeface design. In the event your use of this software is found to infringe on the intellectual property rights of any third party, in any jurisdiction, you will cease use of such software in such jurisdiction or you will secure any and all additional rights necessary for such use in such jurisdiction.

7. Term
The license is effective until terminated. YouWorkForThem has the right to terminate your license immediately if you fail to comply with any term of this Agreement. In addition, YouWorkForThem reserves the right to claim punitive damages. Upon such termination you will destroy the original and any copies of the YouWorkForThem Font Software and related documentation and cease all use of the trademarks.

8. Limited Warranty
YouWorkForThem warrants that the YouWorkForThem Font Software delivered to you to be free of defects in workmanship and manufacture for a period of ninety (90) days from the date of delivery to you as evidenced by a copy of your receipt. YouWorkForThem`s entire liability and your exclusive remedy as to such physical media shall be replaced if the physical media that does not meet YouWorkForThem's Limited Warranty is returned to YouWorkForThem with a copy of the receipt. If failure of any physical media has resulted from accident, abuse, or misapplication, YouWorkForThem shall have no responsibility to replace the physical media. Any replacement of physical media will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE YOUWORKFORTHEM FONT SOFTWARE AND DOCUMENTATION ARE PROVIDED 'AS IS'. YOUWORKFORTHEM DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE YOUWORKFORTHEM FONT SOFTWARE OR DOCUMENTATION. THE FOREGOING STATES THE SOLE AND EXCLUSIVE REMEDIES FOR YOUWORKFORTHEM's BREACH OF WARRANTY. EXCEPT FOR THE FOREGOING LIMITED WARRANTY, YOUWORKFORTHEM MAKES NO WARRANTIES EXPRESSED OR IMPLIED AS TO NON-INFRINGEMENT OF THIRD PARTY RIGHTS, OR FITNESS FOR A PARTICULAR PURPOSE. YOUWORKFORTHEM DOES NOT MAKE ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

9. Limit of Liability
In no event will YouWorkForThem be liable to you for consequential or incidental damage (including damage from loss of business profits or savings, business interruption, loss of business information, and the like) or for claim by any party arising out of the use of or inability to use the YouWorkForThem Font Software, even if YouWorkForThem has been advised of the possibility of such damage.

10. Indemnification
You agree to indemnify and hold YouWorkForThem and YouWorkForThem's suppliers harmless from and against any claims or damage which may result from your breach of this License Agreement.

11. Revisions
This license may be slightly updated from time to time, with the latest version always being available on our website. If you cannot find the latest version on our website, contact us via our website for more details.

12. Law

Third Party License Agreements

Typically our fonts are all covered under our normal font license listed on the left, but some font designers have their own custom licenses. Each font has a license link on its product page. If the license is custom via the type designer, it will be noted as a custom license link. Review the details on this link for that designer's license.

WebFonts

YouWorkForThem WebFonts are available for a one-time fee. There are no subscriptions, no re-occurring fees, no tracking and no stalking -- just pay once and that's it. However, if your traffic goes up, you must upgrade your license to the correct page view amount. (You only need to pay the difference.) Traffic should be based on a six-month average of stats, or a six-month estimate if six months are not yet available.

YouWorkForThem WebFonts are made available in the most modern file formats: EOT, WOFF, SVG, Web Only TTF
The WebFonts licenses are available at the following pricing tiers: In order to complete your purchase, you must agree to the following rules of usage. Remember that when you purchase a font you are only purchasing a license to use that font for your personal or business use. You DO NOT own the font. (Title to, copyright to and full ownership of YouWorkForThem WebFonts are that of the font creator(s). The creator(s) are always listed on the product page for that font.) By downloading, purchasing, or installing YouWorkForThem WebFonts, you signify your acceptance of this license agreement, and in return for a license to use YouWorkForThem WebFonts, you wholly agree to the following terms and conditions:

1. Grant of License and Restrictions
YouWorkForThem grants you a non-exclusive license to use the WebFont for personal or business purposes according to the terms of this Agreement. If the average number of page views under which the WebFont is used exceeds the amount in your purchased Pricing Tier, then you must upgrade your license to the correct page view amount.

2. Uses that are OK
You may use one YouWorkForThem WebFont on one domain name (URL) only. This includes matching domain names with different domain suffixes. For example, YouWorkForThem.org and YouWorkForThem.net are acceptable under one license, providing that they display the same content, and are controlled by the same user. However, different domains must be treated as separate licenses which must be licensed separately. For example, youworkforthem.com and Nanamee.com must purchase two licenses, even if they were to display the same content. Workplace intranets are also acceptable under these same conditions.

3. Uses that are NOT OK
You cannot link the WebFont files across multiple domains. You cannot use these font formats on your desktop or convert to other font formats (for example, you cannot take the WebFonts and convert them to TrueType nor any other current or future format -- if you want the font for desktop use, you must license it for that particular purpose from our website or contact us for details.) You cannot adapt, embed, translate, modify, reverse engineer or create derivative works based on YouWorkForThem WebFonts. You cannot give away copies of YouWorkForThem WebFonts in ways that do not comply with the rest of this agreement. (for example, you cannot make any YouWorkForThem WebFonts available for download on the internet, email them to friends, or trade them on file sharing networks.) You cannot resell YouWorkForThem WebFonts. You can only use YouWorkForThem WebFonts in the Web environment and only for "stylizing HTML pages." You cannot use these font formats for printing purposes, or in any merchandising scenario (i.e. greeting cards, apparel design, et al) or for any interactive text applications where the font can be used by visitors to create or edit text. You cannot use YouWorkForThem WebFonts on subdomains at which the content is NOT controlled by you. THIS INCLUDES SUBDOMAINS that are managed by another party, such as Tumblr, Flavors.me and other external services. (For example, if you are a Tumblr user/customer, you can use the WebFont on YOUR Tumblr page. But if you ARE Tumblr, you can't allow your customers to use the WebFont.) You cannot remove the code in the CSS file that pertains to the YouWorkForThem WebFont. You cannot use YouWorkForThem WebFonts on social networking sites (for example, in a Facebook application, within a blogging community, within an online editor or design tool or any other browser-based web app.) If you want a license for such a use, please contact us. Use of YouWorkForThem WebFonts is exclusive to @font-face technologies and CANNOT be used with other technologies including Cufon, Sifr, etc.

4. Backups
You can keep backups of YouWorkForThem WebFonts in the cloud, locally on a desktop, laptop or mobile device, or on a studio server, ONLY IF you, as the single user/owner is the only person who maintains the backup. It cannot be managed by numerous users.

5. Exclusivity
All rights and licenses not expressly granted to you are reserved by YouWorkForThem. Title to, copyright to and full ownership of the YouWorkForThem web fonts, the YouWorkForThem trademarks, and all patent, trademark, trade name and intellectual property rights associated with the YouWorkForThem WebFonts, remain at all times the property of YouWorkForThem and/or the Font Creator and are not at any time transferred to you or your customers.

6. Termination
YouWorkForThem has the right to terminate your license immediately if you fail to comply with any of the terms listed in this License Agreement. Upon termination, you must destroy the original and any copies of the YouWorkForThem WebFont and accompanying documentation. Remember that when you purchase a font you are only purchasing a license to use that font for your personal or business use. You DO NOT own the font, title or the copyright. Full ownership of YouWorkForThem fonts are that of the font creator(s).

Pricing Structure
This Mobile Application license allows customers to embed ONE (1) OpenType/TrueType font in ONE (1) Mobile Application for a one-time fee of 10x the font price, or $350, whichever is greater. For example, a $20 font with one Mobile Application license would cost $370, while a $100 font with one Mobile Application License would cost $1100.

Approved Formats
This Mobile Application license is valid for integrating and embedding ONE (1) YouWorkForThem font in ONE (1) Mobile Application product at a time, and is valid ONLY for the following operating systems: License Agreement
In order to complete your purchase, you must agree to the following rules of usage. By downloading, purchasing, installing or embedding YouWorkForThem fonts for any Mobile Application use, you signify your acceptance of this license agreement, and in return for a license to use YouWorkForThem fonts for any Mobile Application scenario, you wholly agree to the following terms and conditions:

1. Grant of License and Restrictions
YouWorkForThem grants you a non-exclusive, non-transferable license to (i) integrate, combine, embed or incorporate ONE (1) YouWorkForThem font within your Mobile Application scenario, (ii) reproduce, distribute and sub-license your Mobile Application scenario containing ONE (1) YouWorkForThem font; and (iii) install and use ONE (1) YouWorkForThem font for your use in connection with the creation and testing of your Mobile Application scenario. You are not allowed to use the YouWorkForThem font for more than one Mobile Application scenario without purchasing an additional Mobile Application license from YouWorkForThem. You are not allowed to re-sell or give the font to any third party separate from your Mobile Application scenario. A "Mobile Application scenario" is defined for these purposes as any single scenario that is applicable to the items listed above in the “Approved Operating Systems” section. Note that games or software for non-mobile platforms (Xbox, PS3, PSP, Wii, PC, MAC, etc.) are NOT considered Mobile Applications and are NOT covered under this Mobile Application license. Please contact us for more details if you need an extended license that covers that type of use.

2. Uses that are OK
You may use ONE (1) YouWorkForThem font within ONE (1) Mobile Application scenario only. For instance, you can embed ONE (1) YouWorkForThem font in ONE (1) Mobile Application for multiple mobile platforms from the approved list above. As long as the Mobile Application is identical on the multiple mobile platforms, you only need one Mobile Application license to develop and release the Mobile Application. However, if you release "Awesome App" and then develop a sequel called "Awesome App 2: More Awesome" that also includes the same font, you must purchase an additional Mobile Application license. Essentially each time the font leaves your control and is distributed via an electronic device in a new scenario, you must purchase an additional Mobile Application license. Note, however, that you only have to purchase one Desktop License -- the additional license purchases being described here refer only to the Mobile Application license, which is separate and in addition to the Desktop License.

3. Uses that are NOT OK
Users of the Mobile Application scenario cannot edit or create a new document using the YouWorkForThem font(s). You must ensure that the YouWorkForThem font(s) cannot be fully or partially extracted for any use. You must embed the YouWorkForThem font(s) within a secure format that permits only the viewing and/or printing (and not the editing, altering, enhancing, or modifying) of the YouWorkForThem font(s). You cannot use the YouWorkForThem font(s) in any format that is non-mobile (i.e. Xbox, PS3, PSP, Wii, PC, MAC, etc.)

4. Backups
You can keep backups of the YouWorkForThem font(s) in the cloud, locally on a desktop, laptop or mobile device, or on a studio server, ONLY IF you, as the single licensee of the YouWorkForThem font(s) is the only person who maintains the backup. It cannot be managed by numerous users.
