END USER LICENSE AGREEMENT

SHORT TERMS
- Do not distribute the Typefaces in any form.
- Do not modify the Typefaces in any form.
- Use the Typeface only as a Webfont, not as Desktop fonts or for Apps!This requires a special license)
- Do not convert the Typefaces in other formats.

DEFINITIONS
This is an End User License Agreement (EULA) between you (the End User) and HVD Fonts GmbH. Please read this Agreement carefully. By downloading and/ or installing HVD Fonts GmbH Font Software, you are agreeing to the terms of this license. Subject of the contract are the software and the Typefaces (‘fonts’), which shall be made available by HVD Fonts GmbH. All Typefaces and all soft- ware on this website are the intellectual property of HVD Fonts GmbH.

GRANT OF LICENSE
HVD Fonts GmbH grants you a non-exclusive, non-transferable license to oper- ate its font software on a website from a single company, as indicated on your invoice. You agree not to duplicate, reproduce, sell, transfer, license, or other- wise distribute the Typefaces in any form, except as provided herein. You agree not to decompile, modify, reformat, translate, reverse-engineer or otherwise discover the source code of the Typefaces. You agree not to make, or authorize or commission others to make, any additions, deletions or modifications to the Typefaces without the prior written consent of HVD Fonts GmbH. You agree not to alter HVD Fonts GmbH’s copyright notices as contained in the Typefaces.

COPYRIGHT
HVD Fonts GmbH retains full title and ownership of these Typefaces both as artwork and software, including all subsequent copies of the artwork or software regardless of the format in which they are expressed or the media on which they are recorded. Any updates, revisions, enhancements or additions to the Typefaces supplied by HVD Fonts GmbH under this Agreement shall become part of, and subject to, this Agreement. The parties agree that HVD Fonts GmbH shall own the copyright in all such modifications and derivative works of the Typefaces made by either party. The names of these typefaces are trademarks of HVD Fonts GmbH, and as such may only be used in keeping with accepted trademark practice, including identification of the trademark owner’s name and only in conjunction with output produced using this font software. The parties agree that the Typefaces are the sole and exclusive property of HVD Fonts GmbH, including all applicable rights to patents, copyrights, trademarks and trade secrets inherent therein and appurtenant thereto, and you agree not to challenge HVD Fonts GmbH’s rights thereto, or infringe the rights thereof. You acknowledge that you are not purchasing title to the Typefaces, but are rather being granted a license to use the Typefaces for the purposes set forth above. Except as provided herein, this Agreement does not grant you any intellectual property rights in the Typefaces.

USE RESTRICTIONS
The webfonts may be used for styling text on your website via the CSS @font-face rule for the company specified on your sales receipt. Only the WOFF and EOT webfont files provided by HVD Fonts GmbH may be used. The use of alternate formats (TTF or OTF) is expressly prohibited. Viewing and printing pages of the website using the webfonts is allowed. However, providing the abil- ity for a remote user to edit text using the webfonts is not allowed if the result is a new document, such as a personalized invitation, greeting card, customized portfolio or customized product. These are merely examples. The webfonts are licensed for your use only. You may not use the webfonts as a tool or resource for third parties to create customized products or documents. Further, the webfonts may not be served to unlicensed domains, even if they are hosted on a licensed domain. The use of HVD Fonts webfonts on a desktop, laptop, workstation computer, or for any uses not expressly permitted herein is prohibited. If you wish to use the webfonts in a manner not permitted by this license, you must secure a separate license and/or a license extension by contacting HVD Fonts directly: hannes@hvdfonts.com.

PAGEVIEWS
A pageview is one request for the viewing of a page of your website. The aver- age monthly traffic of your website, measured in pageviews over the span of six consecutive months, must not exceed the amount shown on your sales receipt. If it does, you must purchase a license upgrade for the increased pageview amount. You agree to use reasonable measures to ensure the webfonts are available only for the HVD Fonts GmbH of styling text on your website. At a minimum, and by way of illustration not limitation, reasonable measures include a) preventing unlicensed third-party access, i.e. hotlinking and b) not allowing direct download of the webfonts unrelated to the HVD Fonts of styling text for your website.

LIABILITY
In no event will HVD Fonts GmbH be held liable for any consequential or incidental damages, including any lost profits or lost savings, or for any claim by any party, even if HVD Fonts GmbH has been apprised of the possibility of such damages.

TERMINATION
This license agreement will terminate automatically without notice from HVD Fonts GmbH if you breach any of its provisions. With termination, you must immediately stop using the typefaces and the software and delete all copies of the Typefaces and the software from all medias. All rights to the typefaces, including their names and the software are owned by HVD Fonts GmbH are protected by the copyright laws of Germany and other international provisions. If any part of this contract is found void and enforceable, it will not affect the validity of the balance of the contract, which shall remain valid andenforceable according to its terms. Once downloaded, fonts may not be returned or refunded.
